Ambassador & VIP Pass – Terms & Conditions

1. Definitions
“Ambassador Pass” means a pass issued at the sole discretion of Banff & Lake Louise Tourism (“BLLT”) to Banff employees who have successfully completed the Ambassador Program, valid for one (1) year from the date of completion.
“VIP Pass” means a pass issued at the sole discretion of BLLT to select media, influencers, tourism partners, advisors, or similar individuals for use during an approved period while performing services for BLLT in Banff National Park.
“Pass” or “Passes” refers to both Ambassador Passes and VIP Passes.
“Program” means the Ambassador and VIP Pass program administered by BLLT through the online platform.
“Member Business” means a business or entity participating in the Program that makes one or more Offers available for redemption through the Pass.
“Offer” means a good, service, or experience made available by a Member Business and accessible through the Pass.
“Released Parties” means Bandwango, Banff & Lake Louise Tourism, and all Member Businesses, including their respective subsidiaries, affiliates, partners, officers, directors, employees, contractors, agents, and representatives.
“You / Your” means the individual to whom a Pass is issued and who accesses or uses the Pass through the online platform.
2. Eligibility & Conduct
Passes are issued only to individuals and may not be used by organizations or groups.
You must be at least 18 years of age to receive and use a Pass.
You agree to use the Pass only for its intended promotional and familiarization purposes and in a lawful, respectful, and responsible manner.
BLLT may investigate any suspected misuse, fraud, or violation of these Terms & Conditions and may suspend or revoke a Pass pending investigation.
3. Use of the Pass
Passes may only be used to redeem Offers expressly listed within the online platform.
Passes are non-transferable, may not be shared, sold, assigned, or exchanged, and may only be used by You.
You must present the Pass through the approved online platform at the time of Offer redemption.
You are responsible for safeguarding the Pass and login credentials.
BLLT is not responsible for any technical issues, interruptions, errors, or temporary unavailability of the online platform, including any inability to access Your Pass or redeem an Offer.
Use of the Pass does not create any form of employment, contractor, partnership, or agency relationship between You and BLLT.
4. Member Business Responsibility
Each Member Business is solely responsible for:
• Honouring its Offers
• Setting availability, blackout dates, capacity limits, and redemption conditions for its Offers
• The quality, safety, and delivery of its Offers
Offers may be complimentary, discounted, or provided at regular price, as determined by each Member Business. The Pass does not guarantee free access to any Offer, and You are responsible for paying any applicable fees, taxes, gratuities, deposits, or additional charges required by a Member Business.
Inclusion of an Offer does not guarantee availability at any specific time.
Offers may be modified, suspended, or withdrawn at any time at the discretion of the applicable Member Business.
BLLT does not endorse, guarantee, or make any representations regarding any Member Business or any Offer. Participation by a Member Business does not constitute a recommendation or endorsement by BLLT.
Nothing in this Program creates any partnership, joint venture, or agency relationship between BLLT and any Member Business.
5. Assumption of Risk & Release of Liability
You acknowledge that participation in certain Offers may involve inherent risks.
By using a Pass, You voluntarily assume all risks associated with redeeming any Offer.
To the fullest extent permitted by law, You waive and release the Released Parties from any and all claims, losses, damages, injuries, costs, or liabilities arising out of or related to:
• Use of the Pass
• Redemption of any Offer
• Acts or omissions of any Member Business
All Offers are provided “AS IS”, without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.
To the fullest extent permitted by law, the total liability of the Released Parties for any claim arising out of or related to the Program or the Pass shall not exceed CAD $100.
6. Indemnification
You agree to indemnify and hold harmless the Released Parties from and against any claims, demands, losses, liabilities, damages, costs, or expenses (including legal fees) arising out of or related to:
• Your misuse of the Pass
• Your breach of these Terms & Conditions
• Your violation of any law or third-party rights
7. Pass Validity, Changes & Termination
Passes are issued at no cost and have no cash or resale value.
No refunds, replacements, reissues, or extensions will be provided.
BLLT reserves the right, at its sole discretion, to:
• Modify, suspend, or terminate a Pass or the overall Program at any time
• Revoke Pass access for misuse, fraud, or violation of these Terms & Conditions
8. Communications, Data Sharing & Marketing Consent
By accepting and using a Pass, You expressly consent to receiving electronic communications, including commercial electronic messages, from BLLT and from Member Businesses You engage with, as permitted by applicable law.
You expressly acknowledge and agree to:
• Receiving communications from BLLT related to Your Pass
• Being subscribed to BLLT email communications (You may unsubscribe at any time)
• Your information being shared with Member Businesses You interact with, in accordance with BLLT’s Privacy Policy
Information Shared with Member Businesses
BLLT may share Your personal information, including Your name, email address, and Pass usage details, with participating Member Businesses that You engage with for the purposes of:
• Verifying Pass eligibility and Offer redemption
• Administering and evaluating the Program
• Providing Offers and related benefits associated with the Pass
• Program reporting, analytics, and performance measurement
Marketing Communications from Member Businesses
Member Businesses may use Your contact information to communicate with You directly, including for marketing and promotional purposes, in accordance with their own privacy policies and applicable laws. Any such communications are sent by the Member Business, not by BLLT.
Independent Privacy Practices
Each Member Business operates independently and is solely responsible for its own collection, use, storage, and disclosure of personal information. Once Your information has been shared with a Member Business, it is governed by that Member Business’s privacy practices.
Release of Responsibility
To the fullest extent permitted by law, BLLT disclaims all responsibility and liability for:
• How a Member Business uses or manages Your personal information
• Any marketing communications, opt-in/opt-out processes, or privacy practices of a Member Business
User Choice
You may unsubscribe from marketing communications sent by a Member Business at any time by following the instructions provided in those communications.
Unsubscribing from BLLT communications does not affect communications sent by Member Businesses.

9. Content & Promotional Use
If You create or share content related to any Offer while using the Pass, You grant BLLT and the applicable Member Business a non-exclusive, worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, repost, publish, display, distribute, and share such content, and to authorize others to do the same, for promotional, marketing, and Program-related purposes, with credit where reasonably practicable.
You represent and warrant that You have all rights necessary to grant this licence.
10. Force Majeure
BLLT shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including natural disasters, weather, pandemics, labour disputes, government actions, or technical failures.
11. Governing Law
These Terms & Conditions are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.
12. Amendments
BLLT reserves the right to amend these Terms & Conditions at any time. Updated versions will be posted online. Continued use of a Pass constitutes acceptance of any changes by You.
13. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms & Conditions constitute the entire agreement relating to the Program and supersede all prior communications or understandings.
15. Acceptance
By selecting “I agree” or otherwise accepting the Pass, You acknowledge that You have read, understood, and agree to be bound by these Terms & Conditions.
